Applicant understands that it is unlawful for:
• Any peddler, solicitor, or transient merchant to make exclusive use of any location on any street, alley, sidewalk, or right-of-way for the purpose of selling, delivering, or exhibiting goods or merchandise. See Prescott City Code 4-4-2(B)(2).
• Any peddler, solicitor, or transient merchant to operate in a congested area where such operation may impede or inconvenience the public use of such street, alley, sidewalk, or right-of-way. For the purpose of this article, the judgment of a police officer, exercised in good faith, is conclusive as to whether the area is congested and the public impeded or inconvenienced. See Prescott City Code 4-4-2(B)(3).
• Any person to exhibit or display any copy or facsimile of the original license issued under this article. See Prescott City Code 4-4-2(B)(5).
• Any licensee, or person working on their behalf, to cry out, blow a horn, ring a bell or use any sound-amplifying devise upon any of the streets, alleys parks or other public places of the City or upon private premises where the sound of sufficient volume is emitted or produced therefrom to be capable of being plainly heard upon the streets, avenues, alleys, parks or other public places, for the purpose of attracting attention to any goods, wares or merchandise which such licensee proposes to sell. See Prescott City Code 4-4-8.
• Any peddler, solicitor, canvasser, or transient merchant to display signs on the exterior of any structure; no signs or temporary signs shall be allowed. See Prescott City Code 4-4-2(B)(3).
• Any peddler, solicitor, canvasser or transient merchant, their agents or representatives, to come upon any premises whereon a sign bearing the words “no trespassing” or “no peddlers” or “no canvassers” or “no solicitors” or any combination of such terms or terms similar thereto is exposed to public view or to remain on any premises after having been requested to leave by the owner or occupant thereof whether such premises are posted as specified above or not. See Arizona Revised Statues §§ 13-1502, 13-1503, 13-1504.
